Terms of Service

1. The service

Seven One Eight Systems LLC operates 718 Interchange, a workspace that organizes public records into searchable products: 718 Build, 718 Abate, 718 Property and 718 Bids. Your subscription determines which products your account can open and how many users it covers.

2. Accounts

Accounts are provisioned by us. Each seat is for one named person; logins are not to be shared. You are responsible for activity under your account and for keeping your credentials secure, and you must tell us promptly if you believe an account has been compromised.

3. Subscriptions, fees and renewal

• Fees, plan inclusions and add-on pricing are as set out on our Pricing page or in the order you sign, which prevails if the two differ.
• Monthly plans are billed monthly in advance; annual plans are billed once for the twelve-month term. Fees are exclusive of taxes, which you are responsible for where applicable.
• A term renews for a further term of the same length unless either party gives notice before it ends. We will give at least 30 days' notice of a price change taking effect at your next renewal.
• Fees already paid are not refundable except where the law requires it or we agree otherwise in writing.
• Introductory pricing offered to early-access customers is held for the term you sign.

4. What you may do with the data

Subject to these terms and to the Acceptable Use Policy, you may use the service and its output for your own internal business purposes, including in your own reports and client work.

You may not:

• Resell, sublicense, or redistribute the service or bulk extracts of it, or build a competing data product from it.
• Scrape, crawl or systematically extract the service by automated means, or circumvent rate limits, access controls or product entitlements.
• Share your account, or provide access to people your subscription does not cover.
• Use the service for any purpose the Acceptable Use Policy prohibits.

The underlying public records are not ours and we claim no ownership of them. What we license to you is the service: the organization, the normalization, the connections, the interface and the software.

5. Your content

Saved searches, lists, notes and anything else you create in the product remain yours. You grant us the limited licence needed to host and operate them for you. We will not use your work to build products for anyone else.

6. Data accuracy — read this one

The service organizes records published by others. It does not verify them and cannot make them complete. Coverage, refresh cadence and the specific limitations of every source are published at Data Coverage, and the processing that sits between a source record and a screen is described at Data Methodology. You should read both before relying on the service for anything material.

Nothing in the service is legal, financial, engineering, insurance or compliance advice, and it is not a substitute for professional judgment, for title work, or for a search of an agency's own system.

7. Availability and changes

We aim to keep the service available and its sources current, and we publish the refresh standard we hold ourselves to. We do not commit to a contractual uptime or freshness guarantee except where an Enterprise agreement says so in writing. Sources are outside our control: an agency can change a feed, delay it, or withdraw it, and we will reflect that rather than fabricate around it.

We may add, change or remove features. If we remove something you depend on, we will tell you.

8. Suspension and termination

You may cancel at the end of your term. We may suspend or terminate an account that breaches these terms or the Acceptable Use Policy, that is being used in a way that threatens the service or other customers, or for non-payment. Where the circumstances allow it we will raise the problem with you first.

On termination your access ends. Ask us before your account closes if you need an export of your own work.

9. Disclaimers

Except as expressly stated in these terms, the service is provided “as is” and “as available,” without warranties of any kind, whether express, implied or statutory, including any implied warranty of merchantability, fitness for a particular purpose, non-infringement, or accuracy or completeness of data.

10. Limitation of liability

To the maximum extent permitted by law, neither party is liable for indirect, incidental, special, consequential or punitive damages, or for lost profits, revenue, data or business opportunity, arising out of or relating to the service, even if advised of the possibility. Our total aggregate liability arising out of or relating to the service will not exceed the fees you paid us in the twelve months before the event giving rise to the claim.

Nothing in these terms limits liability that cannot be limited by law.

11. Indemnity

You will defend and indemnify us against third-party claims arising from your use of the service in breach of these terms or the Acceptable Use Policy, or from your use of its output in a way those documents prohibit.

12. Governing law

These terms are governed by the laws of the State of New York, without regard to its conflict-of-laws rules. The state and federal courts located in New York County, New York have exclusive jurisdiction, and both parties consent to venue there.

13. Changes to these terms

We may update these terms. For a change that materially affects customers we will give notice before it takes effect at the next renewal. The date at the top of this page shows when the text last changed.
